A customer wrote me a bad check the other day. I have left him several messages but hasn’t returned any of them. It’s been about a week now and it’s become obvious he has no intentions of paying me. It was a move out cleaning so I have no address for this person; and the account to which the check was written to is closed. All I have is a name and phone number for this guy. Any suggestions on what I can do? Has anyone had this experience before?
April 13, 2009 at 1:22 pm #153445AnonymousInactiveI think your best route is through the police dept. This crime is titled “theft with a financial instrument” The police dept. may be able to track this person down and charge them with the crime. Good luck!

April 13, 2009 at 8:10 pm #153448AnonymousInactivethis has happened to us prior.bottom line.they were sought after and ended up paying me.not through the court either.took some effort.suttons right on.that is a crime,possible felony to.the intention was there from the get go.go get your money.good luck.if you ever have bad vibes in the future verify funds by calling there bank.if they dont cooperate get in with someone at your bank and they can handle verification of funds for the account before you leave the job.if i have bad vibes i will get the money before start or no go.

Our judicial system is set to protect the criminals and deadbeats while putting the honest, hard-working tax payers on the chopping block. Confronting a criminal at their place of employment could be considered harrassment. Infact, if you repeatedly call or visit their home, you could be charged with harrassment. April 14, 2009 at 4:41 am #153452testParticipantIf you get no help from the cops. Maybe you can some how put a contractor lien on the property. I’m not sure how it would be done though. Or you can wait till you have a bad day, your very frustrated, follow thoe wife home so you know where he lives. On your bad day wait for him to come outside and beat him to a pulp and take the few pennies he has in his pocket. Guarantee he’ll think twice before he rips some one off again. Ususally the system don’t do anything. They tell you to sue them and you get stuck with a piece of paper and you need to find a way to collect the money. Great system we have.

I had to go to the county attorneys office and fill out some paperwork one time. It took a couple of months but they did get me my money. Now after saying thaT, I WILL PROBABLY GET ONE TODAY! LOL

April 14, 2009 at 8:42 pm #153455pachecoParticipantI have a copy of a stopped payment check on my wall to remind me…For me to go to the Justice of the Peace and pay $75 or so bucks to try to get $223…go to court with son and deal with the issue just is not worth the hassle. The other was a physician who left the state and for an unknown reason would not pay..and we worked for him for 2 years! Every three months….$505..down the tubes.
In nearly 6 years of doing business we have had a sum total of 4 fail to pay or moved out of state sticking us for a grand total of about $900.
Also, if we take charge cards, it is paid for first….run through and make sure the money is paid ok.
Times are going to get rougher…me thinks.
April 14, 2009 at 10:26 pm #153456KY13ParticipantI wound up calling her at work. Glad I did cause if I would have went down there I would have caused a scene I was so furious. After speaking to her for a while and listening to her plead her case, it became apparent it was all just a misunderstanding. New check is in the mail.
April 18, 2009 at 5:54 pm #153457CJonesParticipantAll good tips here – if ever your instincts tell you to be careful, make sure you get work phone, driver’s lic. #, and date of birth on the check. Everywhere requires this so an honest person should not give you a problem. In Texas we can also file through county district atty office, dept of ‘hot checks’. The good part is, that person can not even get their driver’s lic renewed without paying up! And if they get stopped for a traffic violation, etc. they will be arrested! It places a warrant on their name. It is better to move on quickly and let the authorities handle it after you have given an honest try. Life is too short and you will wind up getting angry every day. Remember “smile”! ha!

Her neighbor saw me stopping by several times the following week and called me to tell me that I was wasting my time. He said she has stuck 2 other carpet cleaners and a plumber in the past 18 months. I won’t tell the whole story but you can imagine how flippin’ mad I was after several phone attempts and failed visits even when I was positive they were home. I called her for the final time, left her a message that said- “After the great job I did for you, you intentionally stole from me?!!! I will stop at nothing to see to it you end up behind bars. I will spend $10,000 to get my $250 from you. She called me back and we got it resolved, I have cash in hand. She is also planning to pay the other 2 carpet guys (my request!) Sometimes you need to bypass the system and tell them how it’s gonna be!
